Wrongful Death Statute of Limitations

Generally speaking, in Pennsylvania, wrongful death claims must be brought within two (2) years of when the decedent (not the personal representative) could have discovered his or her injury and the cause of the injury after a reasonable investigation. In other words, the two year time limit begins running no later than the decedent’s death.

Please be aware that every case is different and you should contact one of the attorneys at Fodera, Long & Lalli immediately to discuss the specific facts of your case. If you wait and allow the statute of limitations to expire, you will lose your right to bring a claim on your loved one’s behalf forever. Contact us today for more information about the statute of limitations and how it would affect your claim.
