Wrongful Death Statute of Limitations
Generally speaking, in Pennsylvania, wrongful death claims must be brought within two (2) years of when the decedent (not the personal representative) could have discovered his or her injury and the cause of the injury after a reasonable investigation. In other words, the two year time limit begins running no later than the decedent’s death.
